As a parent, legal guardian, friend(s) or the person appearing in the photo submitted, I give my consent to Familyjewelry and authorize Familyjewelry to use my name and/or my child(ren)'s name, animal(s), image, photo, in perpetuity, at the discretion of Familyjewelry, on all media platforms currently known and hereinafter listed, including, without limitation, the Familyjewelry website, without compensation.
I understand that the Elements are downloaded at my own risk. While I understand that Mesbijouxdefamille will take reasonable precautions, I acknowledge that Mesbijouxdefamille cannot control the actions of third parties, and should the case arise, Mesbijouxdefamille will not be held responsible for the copying, reproduction, downloading, transmission, and/or posting of the Materials by a third party on another website and/or any other location on the Internet.
By agreeing below to this Agreement and by providing and/or downloading Materials, I agree to fully release and discharge Mesbijouxdefamille and its affiliates, directors, officers, employees, agents and representatives in perpetuity from any and all claims, demands, damages, actions or causes of action whatsoever, including without limitation any claim based on copyright or trademark infringement, moral rights infringement, invasion of privacy, publicity, personhood and/or defamation, and/or any breach of my representations and warranties hereunder, that I, my heirs, executors or administrators may have with respect to, or relating to the use of, the Materials. I shall not have the right to rescind or interfere with the enjoyment of the rights I have granted to Bijou Cremation. I waive any moral rights I may have in connection with the Materials. I also acknowledge that FamilyBijou shall not be obligated to use the Materials or to display and/or distribute any material it creates using the Materials.
I agree to indemnify and hold harmless Mesbijouxdefamille from any and all third party claims, liabilities, demands, damages, actions and/or causes of action whatsoever relating to the use of the Materials, including claims based on copyright or trademark infringement, invasion of privacy, publicity or defamation.
